Court hears that DPP is very busy

A MAN charged with the serious assault of another man is due to be served with a book of evidence at the next sitting of Limerick District Court.
25-year-old Sean Herbert, with an address at Dromin, Ballyhahill, and currently on bail, is charged with a Section 3 Assault of a man on the Ballinacurra Road on July 12, 2009, as well as the possession of a hammer on the same date.

The State sought an adjournment for a number of weeks, but defence counsel objected, stating that the matter had been dragging on in court.
However, Judge Eamon Oโ€™Brien adjourned the case and granted leave for an extension to the State, saying that the โ€œDPP is very busy, big bodies move slowly and they have a lot of books to prepareโ€.
The matter was adjourned for one month and bail was extended on the same terms.
In a connected case arising out of the same set of circumstances, 22-year-old Kevin Oโ€™Grady, with an address at 41 Anglers Walk, Rhebogue, is also charged with a breach of section 3 of the Non-Fatal Offences Against the Person Act 1997.
The matter was also put back for four weeks to accommodate the serving of documents, and bail was extended.
