Solicitor remanded on continuing bail

A Limerick solicitor charged with deception of a former client, has had his case adjourned until January 25. Denis McMahon, (57), with an address at Pembroke Road, Dublin 4, is charged that on or about November 27th, 2002, he did dishonestly by deception, induce a woman to hand over to him a bank draft for €7,500 with the intention of making gain for himself or another. The alleged offence, contrary to section 6 of the Criminal Justice (Theft and Fraud Offences) Act, is alleged to have taken place at the offices of McMahon O’Brien Downes Solicitors, Henry Street.

Det Garda Margaret Nagle of Henry Street Garda station, previously gave evidence of arresting and formally charging Mr McMahon on September 1 last year.
The court has heard that Mr McMahon made no reply to the charge.
The Director of Public Prosecutions has directed that the case be dealt with on indictment; however, the District court was told that the book of evidence was not yet available to be served on the accused.
Mr McMahon’s defence counsel, Brian McInerney, BL, previously told the court the matter would be “vigorously and fully contested and defended”.
Judge Eamon O’Brien remanded the accused on continuing bail and adjourned the case until January 25 for service of the book of evidence.
