Pensioner (75) to face trial over alleged indecent assaults on girl

A Limerick pensioner has appeared before the city’s District Court charged with ten counts of indecent assault on a girl.
The 75-year old accused did not speak during the brief court hearing, which heard the Director of Public Prosecutions had directed the man face a trial on indictment at Limerick Circuit Court.
The offences are alleged to have occurred on dates unknown, between 1982 and 1985, according to charge sheets.
The defendant’s name and address, and the location of the alleged offences, cannot be reported for legal reasons.
Detective Garda Denise Moriarty, Limerick Divisional Protective Services Unit, gave evidence of arresting and charging the accused.
The accused allegedly replied to one of the charges: “I didn’t do that”.
He did not reply to the nine other charges, the court heard.
Prosecuting Sergeant, Sean Moloney, Roxboro Road Garda Station, said the DPP had “directed the accused face a trial on indictment at Limerick Circuit Court”.
Sgt Moloney said gardai were not objecting to bail pic the accused gave an undertaking he would have “no contact directly or indirectly with the injured party in the case”.
Judge Marian O’Leary adjourned proceedings to January 21st, and marked the case “peremptory versus the state” on this date, meaning that, if the State’s book of evidence is not served on the accused by January 21st 2021, the charges may be dismissed.
The man was remanded on bail, on his own bond of €300, which did not have to be lodged.
The man gave an undertaking to be of good behaviour and not contact the alleged victim, including via social media.
