Former Christian Brother faces trial on indecent assault charges

A FORMER Christian Brother and teacher at CBS Sexton Street primary school is to face trial on multiple charges of indecently assaulting 13 young boys in the late 70s. 70-year-old pensioner, Seamus Treacy with an address at Ashton Close, Swords, Co. Dublin, faces 138 separate charges of indecent assaults at the school and at St Enda’s swimming pool on the Kilmallock Road in Limerick between 1978 and 1981. He was served with the book of evidence, which ran to three volumes by Garda Deirdre Foley of Roxboro Garda Station at Limerick District Court on Wednesday morning.

On direction of the DPP, Mr Treacy is to be sent forward for trial to the next sitting of Limerick Circuit Criminal Court.
Judge Eugene O’Kelly gave the accused man the ‘alibi warning’ where should any part of his defence be made up by alibis, he must notify the gardai within 14 days. Defending solicitor Bobby Eagar, applied for legal aid on behalf of Mr Treacy and the court granted that two counsel be assigned given the volume and time span of the charges.
Mr Treacy was released on his own bond of €500 having surrendered his passport to the State and undertake not to apply for any new documents.
An application to impose reporting restrictions on naming the accused man was refused by Judge O’Kelly because of the antiquity of the charges and the fact that the alleged injured parties are no longer minors.
