A SERVING member of An Garda Siochana has been charged with allegedly becoming involved in a street fight in Limerick city and therefore causing affray along with two other men.
31-year-old Garda Adrian Joyce, based at Pearse St Garda Station in Dublin and with an address in Claremorris, Co Mayo was arrested this Tuesday and conveyed to Henry Street Garda Station where he was charged in connection with an alleged incident on July 7, 2013 last.
He, along with his brother 40-year-old brother Nicholas, with and address in Warrington, Lancashire in the UK and another man, David McCarthy (27) with an address at Clareview, Limerick were all charged at Henry Street garda station before being brought to before Judge Eugene O’Kelly at Limerick District Court.
All of the accused men made no reply when they were charged with causing affray contrary to section 16 of the Criminal Justice (Public Order) Act 1994.
It alleged that the off duty garda along with the other two men, used or threatened to use violence on O’Connell Street last July.
Judge Eugene O’Kelly heard evidence from Sergeant Gerard Staunton of charging the three men this Tuesday.
Inspector Seamus Ruane told the court the DPP has elected for summary disposal of the matters which means they will be dealt with in the District Court.
The court heard that there was no objection to bail in respect to all three men and that they were not seeking any special conditions attached to that bail.
The three accused were remanded on bail by Judge Eugene O’Kelly subject to their own bond of €500.
Solicitor Elizabeth Hughes represented the Joyce brothers while solicitor John Herbert appeared on behalf of Mr McCarthy and the court granted an application made by the defence teams for a disclosure by the State of the evidence in the case and any CCTV footage that may exist in relation to the matter.
The cases were adjourned until April 2 next.
