A JURY has been told how gardai found a pipe bomb under a bedside locker in a Limerick flat where a couple and their child were in bed.
The accused’s mother and brother were also in the apartment, the jury at the Circuit Criminal Court in Limerick heard.
John O’Sullivan BL was outlining the evidence which will be heard in the case against Gerard O’Callaghan (27) of Top Cross Ardagh Co. Limerick who is accused of knowingly having in his possession an explosive substance.
Mr O’Sullivan told the jury that gardai entered the ground floor apartment of 15 Upper Cecil Street at 8.30am on January 15 2013 on foot of a search warrant
Mr O’Sullivan told the jury of four women and eight men that Gardai forced their way into the apartment and found the couple in bed.
“When the gardai entered the bedroom, Mr O’Callaghan leaned out of the bed and appeared to be fumbling with something….Gardai give evidence of lifting a locker on that side of the bed and finding a copper pipe containing an explosive substance. The device had a fuse attached”.
Mr O’Sullivan said that there would be evidence of how the accused had shown his brother, Wayne O’Callaghan, a device the previous day and told him it was a pipe bomb.
He warned the duty that he was simply outlining the evidence which the State would present.
“The accused is innocent unless we prove that he is guilty beyond a reasonable doubt,” said Mr O’Sullivan
Mr O’Callaghan is pleading not guilty to the charge.
