THE Director of Public Prosecutions has until January 19 to give directions on how the case against two men charged with a burglary at a house in County Limerick where an elderly man died is to proceed.

62-year-old John O’Donoghue collapsed and died of a heart attack when he arrived home to find two raiders ransacking his home at Toomaline Upper in Doon on August 27 last.

Michael Casey (32) of the Clonlong Halting Site in Southill is charged with two counts of theft and two counts of causing criminal damage at Mr O’Donoghue’s home in Doon and at another house in Kyle, Cappamore on the same day.

It is alleged that he stole jewellery, a watch and various amounts of cash from the homes.

It is further alleged that he caused almost €400 in criminal damage to houses in Dromsalagh and Portnard in Cappamore on the same date.

Seeking that the case be marked peremptory against the State, Casey’s solicitor John O’Donovan said that this was of great concern to his client who was in custody since his arrest.

Judge Marian O’Leary refused the application and remanded Michael Casey and his co-accused cousin David Casey (21) of Caragh Park, Coolock in Dublin, in continuing custody until January 19 next.
