Newcastle West man warned over breaching order

A 25-year-old man has been warned by a judge to behave himself after he was found by Gardaí in his father’s house in breach an exclusion order granted to Limerick County Council two years ago.

Dan McCarthy, originally from 36, Castle View Estate in Newcastle West, was arrested on Monday after Gardaí found him at the house.

Pleading guilty on behalf of his client to the breach of section 5 of the Miscellaneous Housing Act, defending solicitor Michael O’Donnell said that the 25-year-old lived an “isolated existence” in a rural farm since the order was granted.

“He suffers from depression and stress and has his own troubles for which he is on medication”, Mr O’Donnell told Judge Aingeal Ni Chonduin.

However, Mr O’Donnell said that there was “a breakdown with getting his meds”, and his client “was going through a rough patch”. New accommodation had been for the unemployed 25-year-old in Rathkeale and that he wouldn’t breach the order again.

Sgt Adrian Whelan told the court that the defendant had 13 previous convictions and the penalties for this offence were up to six months in prison and or a €500 fine.

Judge Ni Chonduin bound McCarthy to the peace for six months on his own bond of €500 and ordered that if he was found in breach of that bond he would serve 30 days in prison.
